Terms and Conditions

1. Agreement

By creating an account or using Nostos Fit, you agree to these Terms and our Privacy Policy. You may create an account only after ticking that you agree to both documents. If you do not agree, you cannot create an account and must not use the app.

2. The service

Nostos Fit provides fitness tracking tools including workout logging, nutrition and macro tracking, step tracking via Health Connect (with your permission), and gamified progression (XP and levels).

The optional 360° body scan is not required to use the app. It unlocks extra features such as the home turntable display, muscle overlay, and workout volume comparisons. The app is for general fitness and wellness, not medical care.

We may modify, suspend, or discontinue features. We will give reasonable notice where required by law.

3. Eligibility

You must be at least 18 years old to use the optional 360° body capture feature. 360 body capture is not offered to people located in Illinois. You must be old enough to consent in your jurisdiction for other features (at least 16 where required). You are responsible for the accuracy of information you enter.

4. Account

You are responsible for keeping your login credentials secure. Notify us at support@nostosfit.com if you suspect unauthorized access.

You may delete your account in Profile then Settings. Deletion is permanent and removes your account data, workouts, diet logs, steps history, social data, and all 360° body images and metrics from our systems, as described in the Privacy Policy.

5. Health and fitness disclaimer

Body fat %, muscle mass, circumferences, calorie targets, and XP are estimates for motivation and tracking. They are not diagnoses and may differ from clinical or DEXA measurements.

Consult a qualified professional before starting or changing exercise or diet programs, especially if you have health conditions, are pregnant, or take medication.

Assumption of risk. Physical activity carries inherent risk. You use the app and follow any in app guidance at your own risk.

6. Body scan and camera

The optional 360° body scan uses your device camera. Before your first capture you must confirm you are 18 or older, that you are not located in Illinois, and that you consent to camera use. 360 body capture is not offered to people located in Illinois. Workout, diet, steps, and Meal Scan stay available.

Clothing is required. Nudity is not allowed. You must cover genitals, buttocks, and nipples. Sportswear, a sports bra, shorts, or similar athletic clothing is fine. Nude, topless, or sexually explicit 360° captures are prohibited.

You must only scan yourself, or someone you have legal permission to photograph, and only if they are 18 or older. Do not use the feature where photography is prohibited. We may delete violating scans and suspend or close your account.

Pose and segmentation run on your device using MediaPipe. We do not upload raw camera frames for cloud inference. When signed in, processed turntable images and session metadata may sync to your cloud backup, as described in the Privacy Policy.

7. Social and compare features

Your profile visibility is private by default after you create an account or complete a new 360° scan. Nothing is shared until you manually change visibility to friends only or public. Body stills and compare reels can be seen by friends or the public if you change visibility. You are responsible for what you share when you change visibility settings.

8. Acceptable use

You agree not to:

• Reverse engineer, scrape, or abuse the service or other users' data.
• Upload unlawful, harassing, or infringing content.
• Attempt to bypass security, row level access controls, or rate limits.
• Use the app to provide medical services to third parties.
• Capture or upload nude, topless, or sexually explicit 360° body scans.
• Capture or upload images of minors in the 360° body scan feature.
• Upload someone else's body scan without their permission.

We may remove content, suspend, or close accounts that violate these Terms.

9. Intellectual property

The app, branding, and original content are owned by Nostia Labs or its licensors.

Exercise GIFs are licensed from Gym Visual under their Non Exclusive Commercial Royalty Free License. You may use the app as intended, but you may not extract, resell, redistribute, or republish those animation files. Copyright remains with Gym Visual and its licensors.

Third party food data remains subject to its respective licenses.

You retain rights in content you create, including workout logs and 360° scans. You grant us a license to store, process, and display that content to operate the service, including social and compare features you turn on. Your profile visibility is private by default. We may remove content that breaks these Terms.

10. Paid subscriptions

Some features require a paid subscription. The free version of Nostos Fit includes core workout, diet, and step tracking unless we state otherwise at checkout.

When subscriptions are available, the price, billing period (for example monthly or yearly), trial terms if any, and what is included will be shown clearly before you pay. Prices include VAT or other taxes where we are required to collect them.

New subscribers receive a 10 day free trial. A valid payment method is required at signup. You will not be charged until the trial ends. We may send a reminder before the trial ends.

On Android, subscriptions are sold through Google Play billing. On Apple devices, subscriptions are sold through the App Store. The applicable store is the merchant of record and processes payment. We do not store your full payment card details.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel anytime in your Google Play or App Store subscription settings. Cancellation stops future charges. You keep access until the end of the current paid period.

We may change subscription prices, plans, or availability. If we increase the recurring price for your plan, we will give advance notice as required by law and by Google Play or Apple policies. This is usually at least 30 days before the new price applies to existing subscribers. The new price applies from your next renewal after the notice period unless you cancel first. Where the store requires your consent, you must accept in the store before the higher price is charged. If you do not accept, your subscription may end when the current period ends.

We may lower prices. Decreases apply at your next renewal without extra action from you.

We reserve the right to add, change, or discontinue subscription plans. Mandatory consumer rights are not affected.

11. Refunds and billing disputes

If you bought through Google Play, refund requests are handled under Google Play refund policies. You may request a refund through Google Play or your Play purchase history. We cannot override Google Play billing decisions.

If you bought through the Apple App Store, refund requests are handled by Apple. Use Apple report a problem or your purchase history. We cannot issue App Store refunds directly.

For billing questions, accidental duplicate charges, or clear billing errors, email support@nostosfit.com within 60 days of the charge. Include your account email, the store order or transaction ID, the purchase date, and the amount paid.

EU and UK consumers: where you buy digital content or services online, you may have a 14 day right of withdrawal under distance selling rules. For digital subscriptions that start immediately, we will ask you at checkout to confirm that you request immediate access and that you understand you may lose the withdrawal right once the service begins. Rights that cannot be waived by law still apply.

Except where the law or the applicable app store requires otherwise, subscription fees are not refundable for partial billing periods, unused time, or after you have used paid features during that period.

After 60 days from the charge date, voluntary refund requests are usually not available except where law requires.

Nothing in these Terms limits your statutory rights as a consumer in the Netherlands or European Economic Area.

12. Privacy

Our Privacy Policy explains how we handle personal data. It is incorporated into these Terms by reference.

13. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOSTIA LABS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

Our total liability for any claim relating to the app will not exceed the amount you paid us in the twelve months before the claim (or EUR 50 if you paid nothing).

15. Indemnity

You agree to indemnify Nostia Labs against claims arising from your misuse of the app or violation of these Terms, to the extent permitted by law.

16. Changes

We may update these Terms. Continued use after the "Last updated" date means you accept the revised Terms. Material changes may be notified in app.

17. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law rules. Mandatory EU consumer protection rules may also apply where required. Disputes shall be subject to the courts of the Netherlands unless your local law requires a different forum.

18. Entire agreement and severability

These Terms and the Privacy Policy are the entire agreement between you and Nostia Labs for use of Nostos Fit. If any part of these Terms is found unenforceable, the rest remains in effect.
